Terms & Conditions – FishooFresh

FishooFresh (“we”, “our”, “us”) owns and operates the brand FishooFresh and the website www.fishoofresh.com, along with our mobile experience (“Platform”). By accessing or using our Platform, you agree to the Terms & Conditions outlined below.

1. Customer Registration & Privacy

To serve you better, FishooFresh may collect certain personal details during registration or while placing an order, such as:

  • Name

  • Email ID

  • Mobile number

  • Postal code

  • Address and demographic details

  • Preferences and purchase patterns

By signing up or placing an order, you agree to receive transactional updates, notifications, calls, SMS/WhatsApp messages, and promotional communication.
You may opt out anytime by contacting: support@fishoofresh.com.

We do not sell or rent your information to third parties. However, the Platform may include links or integrations (e.g., analytics tools) that are managed by external service providers. FishooFresh is not responsible for how third-party sites handle data.

2. Eligibility to Use the Platform

You may register and use our services only if you are legally capable of entering into a contract under Indian law.
This means:

  • You must be 18 years or older,

  • Of sound mind, and

  • Not prohibited from contracting under any applicable law.

3. Access to the Platform

FishooFresh grants you a limited, non-transferable access to use the Platform strictly for personal, non-commercial use.

You may not:

  • Download, copy, reproduce, or reuse any part of the Platform for commercial purposes

  • Use data scraping tools, bots, crawlers, or similar technologies

  • Republish, frame, or modify any portion of the Platform without written permission from FishooFresh

Any unauthorized use immediately terminates any permission granted to you.

4. Pricing

Prices shown on the Platform are exclusive of GST unless stated otherwise.
The final price charged will be based on:

  • The rate applicable on the date of delivery

  • Weight-based adjustments for fresh seafood (fresh food prices may vary daily)

If the final weight of a cleaned/cut item differs from the displayed weight, the price will be adjusted accordingly at the time of delivery.

5. Delivery & Handling Charges

Delivery fees, packing charges, and applicable taxes may be added based on location, order value, and ongoing policies.

We aim to deliver orders promptly, but delays may occur due to logistics, availability, or unforeseen conditions. Any significant delay will be communicated to you.

6. Order Cancellation

You may cancel your order within 1 hour of placing it by contacting customer support.
Express delivery orders cannot be cancelled as they are processed immediately.

FishooFresh reserves the right to cancel orders due to:

  • Stock unavailability

  • Technical issues

  • Suspected fraudulent activity

  • Violation of Terms & Conditions

Please inspect product seals upon delivery. Returns for damage or quality concerns must be raised promptly.

7. Returns & Refunds

FishooFresh follows a customer-first, hassle-free return policy for issues related to freshness or quality.

  • Any refund or replacement request must be made within 24 hours of delivery.

  • Refund mode may vary (credit to wallet, original payment method, or adjustment against future orders).

  • Cash-on-delivery refunds may be processed as credits to your FishooFresh account for convenience.

8. Wallet / Credits (If Applicable)

If FishooFresh offers wallet/credit features, the terms will be available on the Platform.
These credits may be used for future purchases as per policy.

9. Customer Acceptance

By using the Platform, you agree:

  • To pay additional charges in case of re-delivery due to incorrect address or contact information

  • To share accurate, complete, and truthful information

  • To allow FishooFresh to verify your information at any time

  • To review product descriptions carefully before ordering

  • To accept minor variations in weight for cut or customized seafood portions

  • To use the Platform responsibly and lawfully

10. Customer Obligations

You agree not to use the Platform for:

  • Uploading or sharing unlawful, abusive, defamatory, or harmful content

  • Violating intellectual property rights

  • Gaining unauthorized access to systems or networks

  • Disrupting the Platform’s functionality

  • Sharing misleading information or impersonating others

  • Posting spam, commercial solicitations, or malicious content

  • Uploading reviews containing unlawful or copyrighted material

You are solely responsible for the content of your feedback and agree to indemnify FishooFresh against related claims.

11. Reviews & Feedback

Customer reviews must be genuine and not:

  • Offensive

  • Misleading

  • Promotional

  • In violation of third-party rights

FishooFresh may moderate, remove, or reject reviews that violate guidelines.

12. Unsubscribe / Opt-Out

You can stop receiving marketing communication by emailing:

13. Pictures & Colors

We strive to display products as accurately as possible.
However, variations may occur due to:

  • Lighting

  • Device display settings

  • Natural differences in fresh seafood

Such variations do not qualify as defects.

14. Right to Modify Terms

FishooFresh may update or revise these Terms & Conditions at any time without prior notice.
Continued use of the Platform means you agree to the revised Terms.

15. Governing Law & Dispute Resolution

Any disputes shall be governed by the laws of India.
Unresolved matters will be referred to arbitration under the Arbitration and Conciliation Act, 1996.

  • Language: English

  • Location: Bengaluru

  • The arbitral decision will be final and binding.

  • Bengaluru courts will have exclusive jurisdiction.

16. Copyright & Intellectual Property

All content on the Platform—including text, images, videos, designs, trademarks, logos, and software—is the exclusive property of FishooFresh or its licensors.

You may not:

  • Copy

  • Modify

  • Repost

  • Distribute

  • Recreate

  • Sell
    any content without written permission.

Unauthorized use violates copyright laws and may lead to legal action.

17. Objectionable Content

Despite our best efforts, users may occasionally encounter content considered inappropriate or offensive.
FishooFresh will not be liable for such content but will take corrective action when reported.

18. Indemnity Clause

You agree to indemnify FishooFresh and its representatives against any claims, damages, losses, or liabilities arising from:

  • Your use or misuse of the Platform

  • Violation of these Terms

  • False information provided

  • Breach of laws or third-party rights

This obligation survives termination of your account.
